Comparison Between Pensionado and Rentista Residency in Costa Rica

Legal guidance for retirees and applicants with passive income

Your income can create a path to residency in Costa Rica, but the way it is documented and the choice of principal applicant can affect both the application and life after approval. At Simple Legal Consulting, we review your pension or passive income, family circumstances and relocation plans before recommending how to proceed.

Pensionado Residency in Costa Rica

Pensionado Residency is a temporary residence category for foreign nationals who receive a qualifying lifetime pension from abroad. The principal applicant must demonstrate at least USD 1,000 per month, or its equivalent, through appropriate pension documentation. Eligible family members may apply as dependents.

This route can suit a person retiring alone, a couple moving together or an applicant receiving a qualifying disability or other lifetime pension. The source and duration of the benefit matter. Having reached retirement age or holding substantial savings does not, by itself, establish eligibility.

We review the pension certification before the client spends money obtaining apostilles, translations and additional records. We also consider which spouse should be the principal applicant, how the family applications should be coordinated and the expected steps for enrollment with the Caja Costarricense de Seguro Social, commonly called CCSS or Caja.

Choosing the principal applicant in a couple

When both spouses have a qualifying pension, the higher pension does not automatically make that spouse the better principal applicant. The decision should take account of the available evidence, dependent eligibility and the financial arrangements that will follow approval.

A couple with pensions of USD 3500 and USD 1000

We assisted a pensionado couple in which one spouse received USD 3,500 per month and the other received USD 1,000. We initially considered using the higher pension as the basis of the application. After reviewing the expected CCSS implications, we changed the structure and used the USD 1,000 pension as the qualifying income, with the other spouse applying as a dependent.

The purpose was to meet the immigration requirement while planning for lower social security costs after approval. This illustrates why we consider ongoing expenses before choosing how to file a family application.

CCSS determines the actual contribution through its own assessment. The pension selected for the immigration application does not, by itself, fix the insurance charge, and the financial information CCSS requires must be provided accurately. We assess the possible benefit of this approach in the circumstances of each couple.

The pension evidence we review

A useful pension certification identifies the beneficiary, paying institution, payment amount and currency, and confirms the lifetime nature of the benefit. A bank statement showing a monthly credit may help demonstrate receipt, but it may not establish the legal duration or nature of the pension.

For pensions paid in currencies other than United States dollars, we review the supporting currency conversion and whether the qualifying amount remains sufficient. Where the wording is unclear, we help identify the clarification needed from the pension provider before filing.

Questions about Pensionado Residency

Do both spouses need a pension of USD 1,000 per month?

No. One qualifying principal applicant can support an eligible spouse as a dependent. Each spouse still needs an individual application and the required personal and family documents. We review the relationship evidence and the proposed family structure at the beginning.

Can a disability pension qualify?

It may qualify if the evidence establishes a qualifying lifetime pension and the required monthly amount. Some benefits are temporary, conditional or subject to review. We examine the actual terms and certification rather than assuming that every disability payment meets the requirement.

Can I qualify with Social Security, Military or a private pension?

Yes. We review the issuing institution, entitlement, duration and amount. Government retirement benefits and private pension arrangements require appropriate supporting evidence. The name of a pension product is not enough to determine whether the documentation will satisfy Immigration. But we have been successful in representing pensioners that have pensions from Social Security Administration, Veterans Affairs, Air Force, among other institutions, including from Germany and Switzerland.

Does money in an IRA, 401(k), RRSP or investment account count as a pension?

An account balance alone does not prove a lifetime pension. We examine whether there is a qualifying lifetime payment entitlement. If the assets instead generate stable passive income, Rentista Residency may be more suitable. Any decision to purchase an annuity should also be reviewed with a qualified financial adviser.

Should we always apply through the spouse with the smaller pension?

Yes, as long as it complies with the minimum amount required by the immigration law, as this will create smaller CAJA fees.

Does Pensionado Residency include healthcare without monthly payments?

Enrollment with CCSS and the associated contributions form part of post-approval planning. Immigration eligibility and the CCSS contribution assessment are separate matters. We explain the enrollment steps and review the financial evidence, while CCSS determines the applicable charge. Private insurance does not automatically replace the enrollment required for residency.

Do I have to buy property to apply?

No. Pensionado Residency is based on the qualifying pension. Buying a home is a separate decision. If you intend to purchase property, we can coordinate the immigration work with the legal review of the transaction, without making a purchase a condition of this residency route.

Can I include my children?

Eligible children may apply as dependents, including children under 25 and adult children with qualifying disabilities, subject to the applicable requirements. We review age, dependency, family records and any additional evidence required for the individual family member.

Rentista Residency in Costa Rica

Rentista Residency is a temporary residence option for foreign nationals who can demonstrate stable qualifying income of at least USD 2,500 per month for a period of at least two years. It can be suitable for applicants who have passive income but do not receive a qualifying lifetime pension.

The central question is how your income is generated and documented. A shareholder receiving dividends, an owner receiving rental income and a client using a bank arrangement can require very different evidence. We review the source, the applicant's entitlement to receive the money, the amount available and the basis for its continuity.

At Simple Legal Consulting, we coordinate the legal analysis with accounting support when a Costa Rican certified public accountant, or CPA, is needed. The financial certification and cash flow must be supported by reliable documents. We organize that evidence so the application explains how the qualifying income reaches the applicant.

Passive income from abroad

Foreign dividends and rental income can support a Rentista application when the legal and financial evidence demonstrates the required income. The file must show more than ownership of a valuable asset or shares in a profitable company. It must explain the income available to the applicant and its expected stability over the required period.

We review the records already available and identify any gaps before asking the client to obtain additional documents. Depending on the source, this may involve company resolutions, ownership records, leases, financial information and evidence of payments. We also coordinate the appropriate authentication and Spanish translations.

Bank arrangements in Costa Rica

We have also assisted applicants using capital placed with a local bank under an arrangement designed to support qualifying passive income. In these cases, we coordinate the banking documentation with the accounting and immigration evidence before the application is submitted.

The legal distinction is important: a bank returning your own deposit in monthly installments is not the same as generating qualifying income. The regulations expressly exclude a deposit made simply to be repaid in monthly fractions. We therefore review the actual instrument, income, term and supporting certification rather than presenting a savings balance as sufficient on its own.

The necessary capital depends on the product and its documented income. We do not assume that depositing USD 60,000 automatically qualifies an applicant. Bank approval, source-of-funds review and the immigration decision are separate assessments.

Rentista cases from our practice

  • Dividends from a company in the United States

In a successful Rentista case, our client received dividends from a company in the United States. We used the company's dividend resolution as supporting evidence and worked with our accountant to prepare the cash flow for the application.

The resolution helped document the basis of the dividend payment, while the accounting work organized the financial information needed to support the applicant's income. The practical value of the approach was to use an existing income source and explain it through the appropriate corporate and accounting documents.

For another applicant, the required evidence may differ. We review the right to receive distributions, their amount and continuity, and the documents supporting the accountant's conclusions. Ownership of a company alone does not establish qualifying personal income.

  • Rental income from properties in the United States

Another successful Rentista matter involved income from rental properties in the United States. We prepared the financial presentation with our accountant, using supporting rental contracts and documentation showing ownership of the properties. The relevant documents were translated and uploaded as part of the application.

The application connected the underlying properties and rental arrangements with the cash flow presented for the client. This gave the financial evidence an identifiable basis instead of relying on an unsupported statement of expected income.

When reviewing a new rental-income case, we also examine expenses, financing obligations, ownership through a company and the amount actually available to the applicant. Gross rent collected by a business may differ from the income its owner can lawfully receive.

  • Coordinating a local bank arrangement

Our experience also includes clients using a local bank arrangement to support passive income for Rentista Residency. We coordinate the banking structure with the supporting financial certification and the immigration file, so the documents address the same source and period of income.

Before funds are committed, we review how the proposed arrangement produces and documents the required income. The client also needs to understand the banking terms, access to capital and any restrictions. The application must be based on the actual arrangement agreed with the bank.

What the supporting financial file may contain

·       For dividends: the distribution resolution, evidence of the applicant's entitlement and the financial records needed to support the distribution and cash flow.

·       For rental income: ownership records, leases, evidence of payments and relevant expenses, with additional company documents where the properties are held through an entity.

·       For bank income: the bank's documentation of the instrument, qualifying income, term and payment arrangements, together with any required accounting certification.

The accountant determines the support required for the certification. The legal review addresses whether the resulting evidence supports the residency application and whether foreign documents require authentication and translation.

Questions about Rentista Residency

Do I have to be retired?

No. Rentista Residency is based on qualifying income rather than retirement status or age. It can suit someone with passive income who does not yet receive a lifetime pension. We examine the nature of the income and the proposed activities in Costa Rica.

Can dividends from my own company qualify?

They can support an application when properly documented. We review the distribution resolution, entitlement to receive the dividends and the evidence supporting the amount and continuity. A company's revenue, an owner's salary and a dividend are different things and should be presented accurately.

Can rental properties outside Costa Rica support the application?

Yes, rental income can be assessed as a potential qualifying source. We review ownership, leases and the income available after relevant costs. If a company holds the properties, the file should also explain how the income becomes available to the applicant.

Is a cash flow prepared by an accountant enough?

The cash flow needs a reliable documentary basis. Depending on the case, a formal CPA certification and supporting foreign records will be required. The accountant's work should explain the financial evidence; it does not replace the underlying contracts, resolutions or other relevant records.

Do I have to transfer all my foreign investments to Costa Rica?

We first assess whether your existing foreign income can be documented for the application. A local banking arrangement may be useful in some cases, but it should follow a review of the available alternatives and the relevant legal, banking and financial considerations.

Is USD 60,000 in savings enough to qualify?

A savings balance alone does not establish the qualifying income. A deposit that simply returns your own capital in monthly installments is expressly excluded from the regulatory definition of rent. We review whether there is a genuine, adequately documented income source meeting the required amount and period.

What if my income is paid quarterly or annually?

We review the distribution terms, payment history and whether the evidence can establish the required monthly, stable income over the relevant period. Dividing an annual figure by twelve does not, by itself, demonstrate that the arrangement satisfies the legal requirement.

Can my spouse and children apply with me?

Eligible dependents may apply through the qualifying principal applicant. Each family member still needs the appropriate personal documents and evidence of the relationship. We coordinate the family applications while keeping track of the requirements and progress of each file.

Does this category authorize me to work in Costa Rica?

Rentista Residency does not automatically provide unrestricted permission to undertake paid work. We review any proposed employment, professional services or active business role separately. Ownership of investments and permission to perform remunerated work are distinct questions.

What happens if my income source changes?

Tell us before changing the financial arrangement used to support residency. Renewal depends on continuing to meet the relevant conditions. A change in payer, property ownership, distributions or banking product may require fresh evidence and a review of the effect on your status.

We can review your dividends, rental income or proposed bank arrangement and identify the documents needed for a Rentista application. Schedule a residency consultation

Preparing and Managing Your Residency Application

A well-prepared application begins with a review of the income and the family structure. It also needs a realistic document schedule. Ordering every certificate immediately can create unnecessary expense if the financial evidence is unresolved or a document expires before filing.

Eligibility and financial review

We review your nationality, current immigration position, income source, family members and intended move. We determine whether Pensionado or Rentista is appropriate and consider other categories where your circumstances call for a different route. For couples, we compare the possible principal applicants before choosing the filing structure.

Personal documents and foreign formalities

We prepare a checklist for each applicant. This generally addresses the passport, birth certificate, criminal record evidence and, where applicable, marriage and other family records. We confirm the relevant issuing country, document validity, apostille or legalization requirements, and Spanish translation requirements before submission.

Financial records require their own review. An apostille authenticates a signature or official capacity; it does not establish that the contents prove immigration eligibility. Correct names, dates, income amounts and the legal nature of the payment remain essential.

Application and follow up

Once the file is ready, we prepare the application and use the filing method available for the category and circumstances. Where electronic submission is available, we organize the documents for upload. We monitor the matter and address requests for additional information within the agreed scope of representation.

We also coordinate the applicable local requirements, including fingerprints and consular registration where required. Family members may have separate files and approval dates, so a coordinated application does not mean that every resolution will be issued together.

Approval and documentation

After approval, we review the resolution and explain the payments, CCSS enrollment and appointments needed to obtain the immigration identification document known as DIMEX. Approval and possession of the DIMEX are separate milestones. We help the client plan the sequence so that the final documentation stage is not overlooked.

Renewal and future residence

Pensionado and Rentista are renewable temporary residence categories. The conditions supporting the status and the applicable CCSS obligations must continue to be met. After three consecutive years of temporary residence, eligible applicants may seek permanent residency through a separate application. The change is not automatic.

Comparing the two income routes

Costs and the scope of representation

We provide a written proposal that separates the professional fee from government payments and other expenses. The proposal identifies the principal applicant and dependents, applicable VAT, and the services included in the engagement.

Your budget should also account for foreign certificates, apostilles or legalization, translations, courier services, accounting certification and any bank services. After approval, there may be further government payments, a guarantee deposit, DIMEX charges and recurring CCSS contributions. Accounting, translation and banking services are charged separately unless the proposal expressly includes them.

We review costs in light of the proposed application structure. The pensionado couple described above is an example of why recurring expenses deserve attention at the beginning of the matter.

Working with Simple Legal Consulting

Each Pensionado and Rentista application is personally supervised by Herman Duarte, MSc. & LL.M., founder of Simple Legal Consulting. We give clients a clear document plan, review the financial evidence and coordinate the legal and accounting work needed for the application.

Our work with pensions, company dividends, foreign rental properties and local banking arrangements allows us to assess different sources of income without assuming that every client needs the same structure. We also assist couples, including same-sex spouses, and families whose applications require coordinated documentation.

We explain what is ready, what still needs to be resolved and what comes next. Where residency connects with banking, property purchases or other legal decisions in Costa Rica, we review those matters together so the application fits the client's broader plans.

To begin, tell us where your income comes from, who will apply with you and when you hope to move. We will identify the appropriate next step and the documents needed for the initial assessment. Schedule a residency consultation
